This Disclaimer is provided for information. It explains, in plain language, what IndexTEN is and is not, so that you know what to expect from the Service.
It does not create rights or obligations, and it does not modify our Terms and Conditions. The Terms and Conditions, available at indexten.app/terms, are the binding agreement between you and That Music Teacher, LLC, an Ohio limited liability company doing business as Tarbet Education Network ("Company," "we," "us," or "our"). Our Privacy Policy, available at indexten.app/privacy, governs how we handle personal information. If anything on this page appears to conflict with the Terms and Conditions, the Terms and Conditions control.
1. What IndexTEN Is
IndexTEN is a repertoire organization tool for elementary music educators. It gives you a structure for cataloging, tagging, searching, and organizing the songs and teaching materials you enter into your own library.
IndexTEN is not a repertoire database, song library, or content collection. We do not supply a catalog of songs. Apart from a single example entry provided to demonstrate how the Service works, every song entry, tag, note, saved list, and uploaded file in your library is created, entered, uploaded, or imported by you.
What we provide is the framework — the fields, the classification structure, the search and organization tools. What goes into it is yours.
2. Not Professional, Pedagogical, or Curriculum Advice
IndexTEN is an organization tool, not a substitute for your own professional training, judgment, or expertise as an educator.
Because you create your own entries, tags, and classifications, we make no pedagogical judgment about your repertoire and offer no recommendations, sequences, grade-level assignments, or curriculum guidance. Any such classification within your library reflects your own professional decisions, not ours.
We do not represent that any repertoire, classification, or organizational approach used in the Service is pedagogically appropriate for your students, complies with your district's or state's curriculum standards, or satisfies any certification, evaluation, licensure, or accreditation requirement. You remain solely responsible for the pedagogical decisions you make in your own classroom.
3. No Guarantee of Outcomes
IndexTEN is a tool for organizing your materials. We make no promise that using it will improve your teaching evaluations, your students' achievement, your certification or licensure progress, your efficiency, or any other professional outcome. Results depend on your own practice, context, and effort.
4. No Affiliation or Endorsement
Kodály organizations. IndexTEN draws on Kodály-inspired teaching methodology, and its founder is Kodály-trained. However, IndexTEN and Company are not affiliated with, endorsed by, certified by, accredited by, or sponsored by the Organization of American Kodály Educators (OAKE), the International Kodály Society, the Kodály Institute of the Liszt Ferenc Academy of Music, or any other Kodály-related organization or governing body. Our use of the name "Kodály" refers to the general teaching approach and philosophy associated with Zoltán Kodály, and is not a claim of certification, license, approval, or endorsement by any such organization or by the Kodály estate.
Schools, districts, and employers. We are not affiliated with, endorsed by, or acting on behalf of any school, school district, education authority, university, or teacher preparation program, unless we have a separate written agreement with that institution. Use of IndexTEN does not create any relationship between us and your employer.
Publishers and rights holders. We are not affiliated with, endorsed by, or licensed by any music publisher, arranger, composer, or rights holder.
5. Content You Upload; Copyright Status
You may upload, import, or enter your own MusicXML files, notations, arrangements, notes, and other materials into your IndexTEN library.
We do not review, monitor, pre-screen, verify, or endorse any content you or any other user adds to the Service, and we make no representation about the copyright or licensing status of any song, arrangement, notation, or file in any user's library.
As set out in our Terms and Conditions, you are solely responsible for ensuring you hold the rights necessary to add any content to the Service — including content you received from another person and imported — and for any use you make of content you export. Our copyright policy and process for reporting claimed infringement are described in the Terms and at indexten.app/dmca.
6. Accuracy, Availability, and Ongoing Development
IndexTEN is in an early-access phase of active development. Features, workflows, and the user interface may be added, changed, or removed as the Service evolves. Descriptions of features on our marketing pages reflect our plans at the time of writing and are not commitments.
We work to keep the Service functioning accurately, but software contains errors. We do not warrant that the Service, or any output it produces, is complete, accurate, reliable, current, or uninterrupted. If you notice a problem, we welcome your report, but we do not guarantee that any particular issue will be fixed within any particular timeframe.
7. Links to Our Other Sites
IndexTEN may link to other websites we operate, such as thatmusicteacher.com and tarbeteducationnetwork.com. Those sites have their own terms of use and privacy policies, which govern your use of them. Your IndexTEN subscription does not include access to any product or service offered on those sites unless expressly stated.
We do not currently participate in affiliate or referral programs within IndexTEN, and we do not receive commissions on sheet music or materials you obtain elsewhere. If that changes, we will disclose it.
8. Testimonials and User Feedback
Any testimonials, quotes, reviews, or examples of results we publish reflect the individual experience of the person who provided them. They are not a guarantee, promise, or representation that you will achieve similar results. Individual experiences vary based on classroom context, teaching practice, prior organization systems, and effort.
Testimonials are shared with the contributor's permission. Where a contributor received any compensation, discount, free access, or other consideration in exchange for their statement, we disclose that alongside the testimonial.
9. Warranties and Liability
The binding versions of the matters described on this page are set out in our Terms and Conditions, available at indexten.app/terms — in particular Section 12 (Disclaimers), which covers professional and pedagogical advice as well as warranty disclaimers, and Section 13 (Limitation of Liability). Those provisions govern. Nothing on this page expands, narrows, or replaces them, and you should read them in full.
10. Changes to This Disclaimer
We may update this Disclaimer from time to time. When we do, we will update the Effective Date above. Because this page is informational, changes to it do not alter your rights or obligations under the Terms and Conditions.
